arquivo iniciando com <?xml version="1.0" ?> #22

Quando coloco para ler um xml, aparece o seguinte erro:

'NoneType' object has no attribute 'get_emit'

Aparece tambem esses textos no terminal:

<?xml version="1.0" ?> <TNFe/>

Alguma ideia de como passar desse ponto?
