It seems like there's a bit of a divide on how servers handle this, so we should either be more clear or put it in the spec.

yeah, there's a long and sorry history here.

matrix-org/synapse#4012 is related. matrix-org/synapse#8349 and matrix-org/synapse#8350 made some changes to synapse's handling which fixed matrix-org/synapse#3121.
