Appeals

This appeals policy is provided in Section 3.2 of the OASIS TC Process. Certain actions may be appealed following the process below:

Any participant, contributor, maintainer or PGB member who believes that:

  1. an action taken or not taken by or with respect to Open Projects, or
  2. an action taken or not taken by the OASIS Open Project Administrator,

is in violation of the procedures set forth in the OASIS Open Project (OP) Rules specified by the OASIS Board of Directors, may appeal such action or inaction.

Appellants shall file a complaint within 30 days of the action being appealed or at any time with respect to an inaction. The complaint shall state the nature of the objection(s), including any direct and material adverse effects upon the appellants; the section(s) of the OASIS policies at issue; the actions or inactions at issue; and the specific remedial action(s) that would satisfy the appellants' concerns. Previous efforts to resolve the objection(s) and the outcome of each shall be noted.

Appeals regarding actions or inactions of an OP must be made to the OASIS Open Projects Administrator.

Appeals regarding actions or inactions of the OASIS Open Projects Administrator must be made to the OASIS Board of Directors.

In the case of an appeal to the OASIS Open Projects Administrator: within 15 days of receipt of the complaint, the OASIS Open Projects Administrator shall provide a copy of the complaint to the OP; and within 30 days of such receipt, shall render a decision, with a copy to the OP.

In the case of an appeal to the OASIS Board of Directors: such appeal, in order to be valid, shall be sent to the board comment list ([email protected]) and the relevant OP(s). The Board shall hold a hearing (with the appellants invited) within 45 days of receipt of the appeal. The Board shall render its decision within 30 days of the hearing. The decision of the Board shall be final.

The OASIS Board of Directors has the authority to effect such remedial action as may be necessary to remedy a complaint brought under this process.
